Terms of Logistics Service

EFFECTIVE DATE: 12 MAY 2024

These terms constitute a legally binding Master Service Agreement (MSA) between PEGASUS PDS LIMITED ("The Company") and the User ("The Client"). Accessing this portal implies irrevocable acceptance of these terms.

1. Service Execution Standards

The Company provides specialized logistics and transport services. While we maintain a 99%+ on-time success rate, all delivery timeframes are estimates. The Company shall not be liable for losses arising from delays caused by 'Force Majeure' events, including but not limited to: severe weather, civil unrest, or unannounced infrastructure closures in the Coventry metropolitan area.

2. Liability Limitations

In accordance with UK commercial law, our liability is limited to the direct replacement value of the goods transported or the specific delivery fee paid, whichever is lower. The Company does not accept liability for consequential loss, loss of profit, or indirect damages resulting from logistics failures.

3. User Obligations

The Client warrants that all provided delivery data is accurate. The Company reserves the right to charge an "Abortive Delivery Fee" (£15.00) if a courier is unable to complete a drop-off due to incorrect Client data or lack of access.

4. Governing Law

This Agreement and any dispute or claim arising out of it shall be governed by and construed in accordance with the law of England and Wales. The courts of England and Wales shall have exclusive jurisdiction.
